The one with the
mess to clear up about false statements on future profits

Advised a company in the waste removal industry in relation to it being misled as to the financial stability and likely future profits of an asbestos removal company it was due to acquire.  It was discovered that the acquired company’s director had been running a price fixing mechanism with a public body for the removal of asbestos in several buildings, which immediately ceased on the sale of the company to the client.

The client company pursued the director of the asbestos company for damages and successfully obtained a freezing injunction given the level of fraud alleged against the director.  That injunction was in excess of £500,000, and shortly after obtaining it, the litigation was resolved.
